Please read this Privacy Policy (“Policy”) carefully before using the https://www.schoolofculturalcreativity.com website operated by the School of Cultural Creativity.

Introduction

The School of Cultural Creativity has two educational services… one is online, the other on campus in the Yarra Valley, Victoria, Australia. The campus has policies and practices which are separate from this Policy and that are available by request or via the website. The terms in this document only apply to the website, not the campus. The following terminology applies to this Privacy Policy and any or all Agreements:  The “Service” refers to the https://www.schoolofculturalcreativity.com website operated by the School of Cultural Creativity that may be referred to as the “Organisation”. “Us”, “we”, “our” refers to the website’s representatives. “You”, “your” and “user/s” refers to you, the person accessing this website and accepting the website’s terms and conditions. “PII” refers to “Personally identifiable information”.

This privacy policy has been compiled to serve those who are concerned with how their ‘Personally identifiable information’ (PII) is being used online. PII is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

When do we collect personally identifiable information?

We collect personally identifiable information from our users when, through the website, you register or enrol for a program or service, subscribe to our newsletter, respond to a survey, fill out a form, or order or purchase a program, service or product created by us or a Third Party.

What personally identifiable information do we collect?

The Service users may be asked to provide us with your name, email address, mailing address, phone number, and other details such as your age depending on the nature of the function you have chosen.

How do we use your information?

Our website and associated services are hosted in Australia. If you are outside Australia, your information will be processed and stored in Australia and you are consenting to such processing and storage.

We are committed to protecting your privacy, with your personally identifiable information regarded as confidential. All information is stored on our secure data base. Only employees with written authority provided by the Founder of the Service are able to access and use information collected from individual users on a position or task-related basis.

We use the PII we collect from our users for a variety of reasons but for whose purpose is to provide our users with a continually improved experience of our Service. These reasons include enabling us to deliver the type of materials users need and want; tweaking and updating the functionality of the website; administering enrolment to a program; administering a contest, promotion, survey or other site features; processing orders and sending information and updates pertaining to orders; sending information about our programs, services and products including promotions, specials, gifts and community events; responding to inquiries, requests and questions; and forwarding to users subscribed newsletters.

We will not use false or misleading subjects in our messages and emails. If the message is a promotion, we will represent it as an advertisement in a reasonable way. We will not use your e-mail address, postal address or phone number for unsolicited mail. Any contact made by the Service will only be in connection with the provision, facilitation and promotion of agreed programs, services and products.

If at any time users would like to unsubscribe from emails, you can follow the ‘opt out’ or ‘unsubscribe’ instructions at the bottom of each email to promptly remove you from all correspondence.

You have the right to request sight of, and copies of any and all PII we keep about you and your dependants. You are requested to retain copies of any literature issued in relation to the provision of our programs, products and services. Where appropriate, we shall provide you with written information, handouts or copies of records as part of agreed contracts including enrolment.

Third Party Disclosure

Your personally identifiable information will not be divulged to any third party other than those authorities required to fulfil your requested transactions, or as required by Australian law.

We do not sell, trade, rent or otherwise transfer your PII to outside parties. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, as long as those parties agree to keep this information confidential. We may have to release your information when we are lead to believe release is necessary to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety, to which we will provide you with advance notice if possible.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Privacy Policy for children under 18 years.

Until the time when School of Cultural Creativity opens its primary school on campus in 2018, the website’s Service will not be directed towards children under the age of 18. Instead, the website is designed to provide adults with information.

If you are under 18-years-old, you agree that you have obtained consent from your parent or guardian to subscribe to and make a purchase through the Service and they agree to be bound by these Terms on your behalf.

We will not knowingly collect information for any child under the age of 18.  If we become aware that personal information has been provided and therefore collected from a person under 18 years, we will attempt to contact the parents or caregivers using the contact information provided and secure their agreement to our Terms. Failing this, we will delete the information and terminate the child’s account.

Images

All images containing imagery of our community will be published on the website, social media and newsletters only with the verbal or written consent of the people in the image or the caregivers of the children under 18 years of age in the image. The peoples’ names will not be referred to on the image or tagged in the image. If you are concerned about an image published on the Service and wish for it to be removed, please contact us.

It is strictly prohibited for an identifiable image of a person in our community under the age of 18, where already permitted by their parent or caregiver to be published on the Service, to be shared. It is under strict arrangement that you agree to not republish or redistribute any identifiable image of a minor under any circumstance.  If it is found that an identifiable image of a minor has been shared without permission, the Service will immediately disqualify the user from the Service and the Service may elect to pursue legal action against the user through the Terms in its Intellectual Property clause, Copyright clause, and Privacy Policy.

How do we protect visitor information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning.

Offences exist for unauthorised actions against computer systems and data. We will investigate any such actions against our systems with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Cookies

Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services.

We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future, understand and save user’s preferences for future visits, and keep track of advertisements. We may also use trusted third party services that track this information on our behalf.

We do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings and our technician is happy to advise you on how to do this. Each browser is a little different; you can also look at your browser’s Help menu to learn the correct way to modify your cookies.

If you disable cookies off, some features will be disabled. It may affect your site experience such as efficiency, and some of our services will not function properly.

However, you can still place orders.

Google

We use Google AdSense Advertising on our website.

Google, as a third party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on their visits to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the ‘Google ad and content network privacy policy’.

We implement programs such as remarketing with Google AdSense, Google Display Network Impression Reporting, Demographics and Interests Reporting, and DoubleClick platform integration.

We along with Third Party vendors such as Google, use first-party cookies (such as the Google Analytics cookies) and Third Party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions, and other ad service functions as they relate to our website.

Opting out

Users can set preferences for how Google advertises to you using the Google Ad settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt out page or permanently using the Google Analytics Opt-out Browser add on.

Fair Information Practices

The Fair Information Practices Principles form privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to ensure we continue to protect personal information.

In line with Fair Information Practices, should a data breach occur, we will notify the users via email within 7 business days, and we will notify the users via in site notification within 7 business days.

We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle conveys that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

Access to and Review of the Privacy Policy

Once this Privacy Policy is created, we will add a link to it on the footer in every page of our website.  The link will state “Privacy Policy”.

We reserve the right, at our sole discretion, to modify or replace this Privacy Policy at any time. It is our policy to review this policy annually and on as-needs basis. If a change is required, we will try to provide at least 30 days written notice prior to any new terms taking effect. We will announce these changes on our home page and on other key pages on our website. If there are any changes in how we use our site users’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. You are advised to re-read this statement on a regular basis.

It is your sole responsibility to periodically check the Privacy Policy for any changes. If you do not agree with any of the changes to this policy, it is your sole responsibility to stop using the Service. Your continued use of the Service will be deemed as your acceptance thereof.
